Acceptable Use Policy

This Acceptable Use Policy applies to the Emersoft Books Shopify application, related APIs, integrations, documentation, websites and support services. It forms part of the Terms of Service.
1. Responsibility for Users and Activity
A merchant is responsible for its authorised users, employees, contractors and all activity performed through its Shopify store or connected accounts, except to the extent caused by Emersoft’s breach of security obligations. Merchants must maintain reasonable access controls and promptly report suspected compromise.
2. Lawful and Ethical Use
You must not use the Services to violate any law, regulation, court order, contractual restriction or third-party right. This includes consumer-protection, privacy, data-protection, intellectual-property, tax, sanctions, export-control and advertising requirements.
3. Prohibited Access and Security Activity
You must not:
gain or attempt to gain unauthorised access to the Services, another merchant’s data, Shopify, supplier systems, accounts, networks or credentials;
share Shopify, Gardners, Ingram, Pubnet or other integration credentials with unauthorised persons;
probe, scan or test vulnerabilities without prior written authorisation;
introduce malware, malicious code, ransomware, destructive instructions or harmful content;
disable, bypass or interfere with authentication, permissions, webhooks, rate limits, logging, security controls or usage restrictions;
conduct denial-of-service activity, excessive automated requests, credential stuffing, scraping or other actions that degrade the Services; or
use compromised, fraudulent or unlawfully obtained accounts, payment methods or data.
4. Software and Platform Restrictions
Except where mandatory law permits and cannot be excluded, you must not copy, modify, reverse engineer, decompile, disassemble, translate, create derivative works from, resell, sublicense, mirror or commercially exploit the App, source code, documentation or proprietary interfaces without prior written permission.
You must not use bots, scripts or automated tools except through features and APIs expressly made available by Emersoft and within documented limits.
5. Catalogue, Supplier and Intellectual-Property Restrictions
You must not use catalogue data, book metadata, cover images, ISBN data, supplier files or other licensed materials outside the permissions granted by the relevant supplier or rights holder. You must not remove notices, misrepresent ownership, infringe copyright or trademark rights, or use supplier data to create an unauthorised competing database or service.
6. Orders, Fulfilment and Commercial Misuse
You must not create fraudulent, fictitious, test or abusive production orders; manipulate stock or pricing information to deceive customers or suppliers; evade supplier fees or eligibility requirements; submit orders for prohibited destinations or items; or use the Services to facilitate chargeback fraud, money laundering or unlawful trade.
Testing must be performed only in approved test environments or through clearly identified test orders that do not impose unauthorised costs or obligations on third parties.
7. Privacy and Personal Information
You must collect, upload and disclose only personal information that you are lawfully authorised to process and that is necessary for the selected feature. You must not submit special-category data, full payment-card data, government identifiers, children’s information or other highly sensitive information unless Emersoft has expressly confirmed that the feature supports it and you have a lawful basis.
You must not use the Services to sell personal information, conduct unlawful surveillance, build unauthorised profiles, send data to an unapproved supplier, or ignore a valid privacy, deletion or consent request.
8. Content and Communications
You must not upload, transmit or publish content that is unlawful, fraudulent, defamatory, threatening, harassing, discriminatory, obscene, exploitative, sexually abusive, violent, or that encourages crime or creates a material safety risk.
You must not use the Services to send spam, unlawful marketing, deceptive messages or communications without required consent. Any messaging activity must comply with applicable anti-spam and telemarketing laws and the merchant’s own customer commitments.
9. Sanctions and Restricted Uses
You must not use the Services in violation of applicable sanctions, embargoes or export controls, or on behalf of a prohibited or restricted person or entity. The Services must not be used to support terrorism, trafficking, illegal gambling, prohibited weapons or other serious criminal activity.
10. Fair Use and Technical Limits
Use must remain consistent with your plan, documentation and ordinary bookstore operations. We may apply reasonable rate limits, storage limits, concurrency controls or other safeguards where use threatens security, availability, suppliers, networks or other customers.
Where practicable, we will notify you of excessive use and provide a reasonable opportunity to reduce it or move to an appropriate plan. Immediate restrictions may be applied where necessary to prevent harm, cost, abuse or security risk.
11. Investigation and Enforcement
We may investigate suspected violations, preserve relevant records, request information, restrict features, block integrations, suspend or terminate access, and notify Shopify, suppliers, affected parties or authorities where reasonably necessary and lawful.
We will consider severity, repetition, risk and whether the issue can be remedied. Where immediate action is not required, we will normally provide notice and an opportunity to cure. No credit or refund is due for a suspension caused by a material violation of this Policy.
12. Reporting Concerns
Report suspected abuse, security issues or policy violations to [email protected] or through https://emersoft.co/contact. Include sufficient detail to investigate, but do not send passwords, API keys or access tokens.
13. Changes to This Policy
We may update this Policy for legal, security, supplier, platform or operational reasons. Material changes will be notified through the website, email, the App or another appropriate method. Urgent changes may take effect immediately where necessary to prevent harm or comply with law.
